TERMS OF SERVICE

These Terms of Service govern your access to and use of the Avira website, enquiry form, AI preview workflow, and related concierge services (together, the "Service"). By using the Service, you agree to these Terms.
In these Terms, "Avira", "we", "us", and "our" means Avira Aesthetics, an online introduction and concierge business based in Valencia, Spain. Avira is not a clinic, hospital, doctor, insurer, or regulated travel agency.

1. Scope and Acceptance
The Service is designed to help customers explore aesthetic treatment options, receive AI-generated illustrative previews, and request introductions to clinics that may be suitable for their goals. If you do not agree to these Terms, do not use the Service.
By submitting a request, you confirm that you understand Avira acts only as an intermediary and concierge service. The medical, dental, surgical, or aesthetic treatment relationship is between you and the clinic that you choose, not between you and Avira.
2. What Avira Provides
- Avira may generate AI-based preview images from the photo and goals you submit.
- Avira may identify and introduce clinics that appear to have relevant experience for the treatment you are exploring.
- Avira may assist with concierge support, including sourcing, translation, and practical guidance on travel or accommodation.
Unless stated otherwise on the Site, Avira's service fee is EUR 50. That fee covers Avira's time in preparing AI images, sourcing clinics, translation, logistics support, and related concierge work. It does not form part of any clinic's treatment price.
The scope of Avira's engagement is agreed online when you submit your image and request the concierge service.
3. What Avira Does Not Provide
- Avira does not provide medical advice, diagnosis, treatment, prescriptions, or outcome guarantees.
- Avira does not validate the professional competence, licensing status, or regulatory standing of a clinic or practitioner. Avira may ask for evidence of licences or review public information, but this is not legal, medical, or regulatory verification.
- Avira does not hold, collect, redistribute, or administer any part of the clinic's treatment price.
- Avira does not hold deposits, booking fees, prepayments, or repayments on behalf of any clinic.
- Avira does not enter into the medical treatment contract. That contract, together with any clinic quote, informed consent, procedure terms, or aftercare obligations, is between you and the clinic.
4. Eligibility and Your Responsibilities
You must be at least 18 years old, or otherwise legally capable of requesting the Service in your jurisdiction, to use Avira on your own behalf. If you are acting for another person, you confirm that you have authority to do so.
You must provide accurate, current, and complete information. You are responsible for deciding whether a clinic, practitioner, quote, or treatment is suitable for you. You must independently confirm any clinic licences, professional registrations, insurance, and regulatory compliance that matter to you.
You may only upload photos and materials that you own or are entitled to share. If another person appears in an uploaded image, you must have that person's valid permission. Do not upload illegal, abusive, misleading, or infringing material.
5. AI Previews and Content Rights
All AI previews are approximate visual interpretations of the goals you describe. They are illustrative only and are not expert opinions, treatment plans, or promises of what a clinic can achieve. Actual outcomes may differ materially.
You retain your rights in the original photos and text that you submit. You grant Avira a limited, non-exclusive licence to host, process, store, reproduce, adapt, and share that content only as needed to operate the Service, generate previews, communicate with you, and introduce you to clinics.
Avira will not use your uploaded images for public marketing, advertising, or other commercial reuse without your prior consent.
The Avira website, branding, layout, and service materials remain the property of Avira or its licensors. You may not copy or exploit them except as allowed by law.
6. Clinics and Third-Party Services
Any dispute regarding diagnosis, treatment, pricing, consent, complications, refunds, clinical negligence, or clinical outcome must be resolved directly between you and the clinic or practitioner concerned. Avira is not a party to that dispute.
Avira may share your expectations, photos, and AI-generated visuals with clinics so they can decide whether they wish to engage with you. Any clinic response, quotation, treatment proposal, or medical recommendation comes from that clinic, not from Avira.
Avira may refer to public reviews or other publicly available information when discussing clinics, but Avira does not endorse, certify, or guarantee any third party. Travel, accommodation, transport, financing, and other third-party services remain separate arrangements with those providers.
7. Fees, Payments and Refunds
The Avira service fee is payable to Avira for the concierge and AI-preview service only. All clinical fees are paid directly to the clinic selected by you.
Unless Avira states otherwise in writing, Avira's initial consultation and concierge fee is non-refundable, including where:
- no clinic accepts the case or no suitable clinic can be identified;
- you decide not to proceed with a clinic;
- a clinic's price, availability, or response does not meet your expectations; or
- you choose not to travel or book treatment.
Avira may change its fees for future requests by updating the Site.
8. Privacy and Data Sharing
By using the Service, you acknowledge the Privacy Policy and Cookie Policy. You understand that the Service requires Avira to process your submitted data, including photos and treatment goals, and to share relevant information with clinics and service providers involved in delivering the Service.
If you withdraw a consent that is necessary for Avira to continue the Service, Avira may stop processing the request or close your case.
9. Disclaimers and Limits of Liability
To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. Avira does not warrant that the Service will be uninterrupted, error-free, or suitable for any particular purpose.
Avira is not liable for the acts, omissions, advice, fees, quotes, scheduling, cancellations, complications, clinical results, or regulatory compliance of any clinic, practitioner, hotel, airline, transport provider, or other third party.
To the fullest extent permitted by law, Avira is not liable for any indirect, consequential, incidental, special, or punitive loss, or for loss of opportunity, travel costs, disappointment, or medical outcome. Avira's total liability arising out of the Service is limited to the amount you paid directly to Avira for the specific request giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights under applicable law.
10. Suspension and Termination
Avira may suspend, refuse, or terminate access to the Service if you breach these Terms, provide false information, misuse the Service, upload unlawful content, or create legal, security, or reputational risk for Avira or others.
You may stop using the Service at any time. Termination or closure of your request does not create a right to a refund where the Avira fee is stated to be non-refundable.
11. Governing Law and Disputes
These Terms are governed by the laws of Spain. The courts of Valencia, Spain will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.
Before starting court proceedings, both sides should first try to resolve the issue by contacting the other in writing and allowing a reasonable time for response.
12. Changes and Contact
Avira may update these Terms from time to time. The updated version takes effect when posted on the Site unless a later date is stated.
